Terms and conditions of use

Article 1. Object

The purpose of the present general conditions of use is to provide a legal framework for the terms and conditions of provision of the services of the Les Mouettes Vertes website and their use by the user.

The general conditions of use must be accepted by any user wishing to access the site. They constitute the contract between the site and the user. Access to the site by the user signifies acceptance of these general conditions of use.

In case of non-acceptance, the user must renounce to the access of the services proposed by the site. Les Mouettes Vertes website reserves the right to unilaterally modify the content of these general terms of use at any time.

The edition of the site Les Mouettes Vertes is ensured by the companyLes Mouettes Vertes (SAS) with a capital of 10 000,00€ and whose head office is located at 5 Rue de Londres, 53000 Laval. The director of the publication is Mr Aymeric Mautin.

The host of the site Les Ateliers des Mouettes is the company L'Atelier des Mouettes (SAS) with a capital of 10 000,00€ and whose registered office is located at 5 Rue de Londres, 53000 Laval.

Article 3. Definitions

The purpose of this clause is to define the various essential terms of the contract:

• User: This term refers to any person who uses the site or any of the services offered by the site.
• User content: this is the data transmitted by the user within the site.
• Member : the user becomes a member when he is connected and identified on the Club LMV website.
• Username and password : it's all the information necessary to identify a
  user on the Club LMV website. The login and the password allow the user to access services reserved to the members of the site. The password is confidential.

Article 4. Access to the services

The site allows the user free access to the following services:

• News articles
• Detailed product sheets
• Putting people in touch with each other and hosting files through contact forms

The site allows the Club LMV member free access to the following services:

• Detailed product sheets
• File hosting
• Ordering platform

The site is accessible free of charge at any location to any user with Internet access. All costs incurred by the user to access the service (hardware, software, internet connection, etc.) are at the user's expense.
As the case may be:

• The non-member user does not have access to the services reserved for members. To do so, he/she must identify himself/herself with his/her username and password.
• The site implements all the means at its disposal to ensure quality access to its services. The obligation being of means, the site does not commit itself to reach this result.
• Any event due to a case of force majeure resulting in a malfunction of the network or the server does not engage the responsibility of Les Mouettes Vertes.
• Access to the site's services may be interrupted, suspended or modified at any time without notice for maintenance or any other reason.
• The user undertakes not to claim any compensation as a result of the interruption, suspension or modification of this contract.
• The user can contact the site by email at contact@lesmouettesvertes.fr.

Article 5. Intellectual property

The brands, logos, signs and any other textual or visual content are protected by the Intellectual Property Code and more particularly by copyright. The user requests prior authorization from the site for any reproduction, publication or copy of the various contents. The user undertakes to use the contents of the site in a strictly private context; any use of the contents for commercial purposes is strictly forbidden.

Any content put online by the user is of its only responsibility. The user undertakes not to put online any content that could harm the interests of third parties. Any legal action taken by an injured third party against the site will be borne by the user.

User Content may be removed or modified by the Site at any time and for any reason. The user does not receive any justification and notification prior to the deletion or modification of user content.

Article 6. Liability and force majeure

The sources of the information published on the site are deemed reliable. However, the site reserves the right not to guarantee the reliability of the sources. The information given on the site is for information purposes only. Thus, the user alone assumes full responsibility for the use of the information and content of the site. Members are responsible for keeping their passwords secret. Any disclosure is forbidden. The members assume the risks related to the use of their login and password. The site declines all responsibility.

Any use of the service by the user that directly or indirectly results in damage must be compensated for by the site. An optimal guarantee of the security and confidentiality of the transmitted data is not ensured by the site. However, the site undertakes to implement all the necessary means to guarantee the security and confidentiality of the data as best as possible.

The responsibility of the site can not be engaged in case of force majeure or unforeseeable and insurmountable fact of a third party.

Article 8. Outgoing hypertext links

Outgoing hypertext links are present on the site, however the web pages where these links lead do not engage the responsibility of L'Atelier des Mouettes which does not have the control of these links. The user thus refrains from engaging the responsibility for the site concerning the contents and the resources relating to these outgoing hypertexts links.

Article 9. Evolution and duration of the contract

The site reserves the right to modify the clauses of this contract at any time. The duration of this contract is indefinite. The contract is effective for the user as of the use of the service.

Article 10. Applicable law and competent jurisdiction

French law applies to this contract. In the event of failure to resolve a dispute between the parties amicably, only the courts of the city of Paris shall have jurisdiction.
